Terms of Service

By accessing or using our Apps, you agree to these Terms and our Privacy Policy. If you do not agree with any part of these Terms, you must not use our Apps.

You may use our Apps for lawful purposes only. You agree not to: • Reverse-engineer, decompile, or disassemble the Apps (except as and only to the extent that any foregoing restriction is prohibited by applicable law, including EU Directive 2009/24/EC on the legal protection of computer programs, or to the extent as may be permitted by the licensing terms governing use of any open-sourced components included with the Apps). • Modify, adapt, or create derivative works based on the Apps. • Use the Apps in any way that violates applicable laws or regulations. • Attempt to gain unauthorized access to any part of the Apps or related systems. • Distribute or make the Apps available over a network where they could be used by multiple devices at the same time. • Transfer, redistribute, or sublicense the Apps to any third party. • Remove, alter, or obscure any proprietary notices in the Apps.

You agree that we may collect and use technical data and related information — including but not limited to technical information about your device, system and application software, and peripherals — that is gathered periodically to facilitate the provision of software updates, product support, and other services related to the Apps. We may use this information, in a form that does not personally identify you, to improve our products or to provide services and technologies to you. Our collection and use of personal data is governed by our Privacy Policy, available at https://shemyakin.dev/privacy-policy.

Some of our Apps offer in-app purchases and subscriptions processed through the Apple App Store, Google Play Store, and managed via RevenueCat. • All purchases are subject to the terms and conditions of the respective app store. • Subscription renewals are handled automatically by the app store unless canceled by you before the renewal date. • Refund requests must be directed to Apple or Google, as applicable, in accordance with their refund policies. • We do not process or store payment card information directly. • Prices may vary by region and are displayed in your local currency at the time of purchase.

The Apps may enable access to third-party services, content, and websites (collectively, "External Services"). You agree to use the External Services at your sole risk. • We are not responsible for examining or evaluating the content or accuracy of any third-party External Services, and shall not be liable for any such third-party External Services. • Data displayed by any External Service, including but not limited to financial, medical, and location information, is for general informational purposes only and is not guaranteed by us. • You will not use the External Services in any manner that is inconsistent with these Terms or that infringes the intellectual property rights of any party. • You agree not to use the External Services to harass, abuse, stalk, threaten, or defame any person or entity. • External Services may not be available in all languages or in your country and may not be appropriate for use in any particular location. • We reserve the right to change, suspend, remove, disable, or impose access restrictions or limits on any External Services at any time without notice or liability to you.

All content, design, code, and other materials in the Apps are owned by Oleksandr Shemyakin and are protected by intellectual property laws. The Apps are licensed, not sold, to you. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Apps for personal purposes on devices that you own or control, in accordance with these Terms and the applicable app store Usage Rules. This license does not grant you any right to use our trademarks, trade names, or service marks.

The Apps are provided "as is" and "as available," with all faults and without warranties of any kind, whether express, implied, or statutory, including but not limited to the implied warranties and/or conditions of merchantability, of satisfactory quality, of fitness for a particular purpose, of accuracy, of quiet enjoyment, and of non-infringement of third-party rights. No oral or written information or advice given by us shall create a warranty. We do not guarantee that the Apps will be uninterrupted, error-free, or free of harmful components. Should the Apps prove defective, you assume the entire cost of all necessary servicing, repair, or correction. Some jurisdictions do not allow the exclusion of implied warranties or limitations on applicable statutory rights of a consumer, so the above exclusion and limitations may not apply to you.

To the maximum extent permitted by applicable law, Oleksandr Shemyakin shall not be liable for any indirect, incidental, special, consequential, or punitive damages whatsoever, including but not limited to damages for loss of profits, loss of data, business interruption, or any other commercial damages or losses, arising out of or related to your use of or inability to use the Apps, however caused, regardless of the theory of liability (contract, tort, or otherwise) and even if we have been advised of the possibility of such damages. In no event shall our total liability to you for all damages exceed the amount you actually paid for the App or fifty euros (€50), whichever is greater. Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable law. Some jurisdictions do not allow the limitation of liability for personal injury, or of incidental or consequential damages, so these limitations may not apply to you.

These Terms are effective until terminated by you or by us. Your rights under these Terms will terminate automatically if you fail to comply with any of their terms. We may also suspend or terminate your access to the Apps at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users or the Apps. Upon termination, your license to use the Apps is immediately revoked.

You agree to comply with all applicable export and re-export control laws and regulations, including EU Regulation 2021/821, the sanctions regulations of the European Union, and any applicable national export control laws, when using the Apps. You may not use, export, or re-export the Apps in violation of any such laws or regulations or for any purposes prohibited thereby.

These Terms shall be governed by and construed in accordance with the laws of the Republic of Poland. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Kraków, Poland. If you are a consumer residing in the EU, you may also be entitled to use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr. Specifically excluded from application to these Terms is the United Nations Convention on the International Sale of Goods.

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Oleksandr Shemyakin regarding the use of the Apps, and supersede any prior agreements or understandings.

We may revise these Terms at any time by updating this page. For material changes, we will make reasonable efforts to provide notice (e.g., via an in-app notification). Your continued use of the Apps after any changes constitutes acceptance of the new Terms.
